EB-2 NATIONAL INTEREST WAIVER (NIW) GREEN CARD FOR INDIVIDUALS HOLDING ADVANCED DEGREES OR HAVING EXCEPTIONAL ABILITY

The EB-2 NIW (Employment-Based Second Preference, National Interest Waiver) visa is designed for members of the professions holding an advanced degree or its equivalent, or persons who have exceptional ability in the sciences, arts, or business. The EB-2 NW visa is a direct route to permanent residency in the United States for those who qualify. The EB-2 NIW visa category allows individuals to waive the typical job offer and labor certification requirements, making it an attractive option for those who can demonstrate that their work is in the national interest of the United States. It is designed for professionals, researchers, and individuals with who can significantly contribute to the country’s economy, health, culture, or other areas of importance.

To qualify for the EB-2 NIW visa, you must meet the following criteria:

1. Advanced Degree or Equivalent: Demonstrate that you have a U.S. advanced degree or a foreign equivalent degree, or an official academic record showing that you have a U.S. baccalaureate degree or a foreign equivalent degree and at least 5 years of progressive post-baccalaureate work experience in your field. Alternatively, show exceptional ability in the sciences, arts, or business (see #2 below).

2. Exception Ability: Demonstrate exceptional ability in the sciences, arts, or business by meeting at least three of the criteria below:

• Official academic record showing that you have a degree, diploma, certificate, or similar award from a college, university, school, or other institution of learning relating to your area of exceptional ability
• Letters from current or former employers documenting at least 10 years of full-time experience in your occupation
• A license to practice your profession or certification for your profession or occupation
• Evidence that you have commanded a salary or other remuneration for services that demonstrates your exceptional ability
• Membership in a professional association(s)
• Recognition for your achievements and significant contributions to your industry or field by your peers, government entities, professional or business organizations
• Other comparable evidence of eligibility is also acceptable.

3. Proposed Endeavor: Demonstrate that your proposed endeavor in the U.S. is of substantial merit and has a national impact or influence. You must demonstrate that your proposed endeavor is in the national interest of the United States, which can be evidenced by contributions to the economy, healthcare, education, sciences, arts, or other fields that have significance for the country.

4. Well-Positioned: Demonstrate that you are well-positioned to advance your proposed endeavor, based on your education, skills, knowledge, record of success in related efforts, model or plan for future activities, progress toward achieving the proposed endeavor, and/or interest or support from potential customers, users, investors, or other relevant entities or persons. 

5. Significant Benefit: Demonstrate that waiving the job offer and labor certification requirements would benefit the United States to a greater extent than requiring them. Provide evidence of how your proposed endeavor of national interest would contribute significantly to the country’s progress, development, or welfare.
